First、 Race, discrimination and equality.
June 22 (tomorrow) is the Dragon Boat Festival. The long-standing traditional culture endows the Chinese with national integrity. At the same time, wherever you go, you must also learn and understand other ethnic groups. Different races, cultures, scripts, skin colors, places of birth, nationalities, religious beliefs, etc., as well as age, gender, disability, and sexual orientation are different. Different people inevitably have different understandings and perceptions. But all should be treated equally, and should not be discriminated or treated differently because of the above differences.
On June 21, "Indigenous Canadian Reconciliation Day" is to reflect on the cruel and unfair treatment of the Canadian government's genocide and cultural genocide against the aboriginal people more than 100 years ago.
Reflecting on the 100th anniversary of the "Chinese Exclusion Act" on June 24, Chinese Canadians gathered on Parliament Hill in Ottawa to remind the Canadian government to remember the shame of history and not to make similar mistakes again.
Second: some suggestions:
1. After understanding the legal concept of racial discrimination, one should know what constitutes racial discrimination in daily life (it has been mentioned in the previous lesson, so it is omitted here).
2. Know how to deal with racial discrimination.
a) First of all, call the police, and be sure to call the police. Try to keep on-site evidence as much as possible. If not, then your words, the situation and content you said are evidence. The police will first determine that your words are true, so you must tell the truth; otherwise the legal consequences will be serious.
b) Canada is legal. Know how to solve it through normal communication channels. For example, seek media reports and disclosures, and communicate with the police through representatives of communities and social organizations.
c) Understand and utilize relevant regulations in the workplace. There should be relevant regulations in the company and unit. If you have been discriminated against or harassed in these places, you must file a civil lawsuit
Beg. If there are no relevant regulations, or no protection, you can file a complaint against the company or unit through the Labor Law.
d), Canadian law focuses on procedural justice. The legitimacy of the evidence. As long as the evidence is sufficient and legal, it would be better to let go of one thousand than to sentence one.
e) Cooperate with the police as much as possible and provide evidence in your favor, instead of cooperating and providing evidence against you (Note: This is particularly important. You do not have to cooperate with the police
Inspect. Cooperation is voluntary on your part and investigation and evidence collection is what the police must do).
f) In law enforcement, the police have the flexibility to issue fines and arrest people. They can enforce the law or let it go. But for the "release of people", it "must" be implemented, and there is also a "must" that cannot be discounted at all.
(Note: So you have to understand: what is "allowable" by the police, you have to be reconciled and strive to "let you go". What is "must", you must firmly "must" let you go).
3. Case
1) A middle school in a Caucasian district transfers an Asian Korean student. The Caucasian student provokes and makes an appointment with a Korean medical student (it is not illegal to make an appointment to drive). As a result, the Korean students beat the white students. After being complained, the police took him away. So the representative of the Korean community went to the police to communicate the theory. After understanding and verifying the situation, the complaint was withdrawn.
2) A group of young people's party affected residents and received complaints. Then a black policeman went to understand the situation and was insulted: "Death to the black policeman". When the black policeman registered the license plate number, he knocked off the clothes on the car. The other party asked to pick them up, but the policeman refused. A few days later, the young man met the policeman and had another altercation. Insulting the police, the police have affected the law and order and brought him back to the police station. The young man complained that the policeman knocked down and soiled his clothes before and needed compensation. When the police station verified the situation, they learned that the young people abused: "Death to the black policeman". It is a racially discriminatory speech. However, the police did not have relevant records in the report and reported it. So the black policeman was suspended for investigation. Black cops hire lawyers to file complaints against police department. The reason: The other party scolded police status, not hatred of black people. It is legally innocent to scold the police. After nearly 4 years, the police won. And received a large amount of compensation from the police station (Note: scolding the police, the police station can scold the skin color, nationality suspected of racial discrimination).

一、种族、歧视与平等。
6月22日 (明天) 就是端午节了,悠久的传统文化赋予华人都有民族气节。同时到任何地方也要学习和了解其他民族。不同种族、文化、文字、肤色、出生地、国籍、宗教信仰等,及年龄、性别、残疾、性取向有所不同。不同的人难免有不同的认识、感知。但都应平等对待,不能因为以上区别而歧视、区别对待。
6月21日,「加拿大原住民和好日」.是反思100多年前,加拿大政府对原住民进行种族文化灭绝的残忍行为、不公正对待。
6月24日,反思「排华法案100周年」,加拿大华人集会渥太华国会山庄也是不断提醒加拿大政府, 记住历史耻辱, 不要再犯类似的错误。
二、几点建议:
1、了解了种族歧视的法律概念,应该知道在日常中,哪些属于种族歧视 (前课已讲,此处略)。
2、知道遇到了种族歧视应该如何应对。
a)、首先要报警,一定要报警。尽量保留现场证据,如果没有,那么你的话、你讲的情况和内容就是证据。警察首先认定你的话是真实的所以你一定要如实的讲述,否则承担的法律后果是严重的。
b) 、加拿大是讲法律的。要懂得通过正常的沟通渠道解决。例如、 寻求媒体道报、披露,通过社区、社团组织代表与警局沟通等。
c) 、了解和利用工作场所的有关规定。在公司、单位都应该有相关的规定。如果在这些地方受到了歧视、骚扰一定要提出民事诉
求。如果没有相关规定,或不予保护,可以通过「劳动法」投诉公司、单位。
d)、加拿大法律注重的是程序正义。即证据的合法性。只要证据充分、合法.宁可放过一千也不错判一个。
e)、对警察要尽可能的配合并提供对你有利的证据,而不要配合并提供对你不利的证据(注:这一点特别重要。你没有必要配合警
察。配合是你的自愿,调查取证是警察要做的的事)。
f)、警察在执法中对于开具罚单、抓人等措施有「可以」这个灵活度的把握,「可以」执法,也「可以」放过。但对于"放人"就「必须"」执行,也有「必须」这个丝毫不能折扣的硬扛。
(注: 所以你一定要了解: 什么是警察"可以"的,你要态度和好、争取「放过」你。什么是「必须」的,你要坚定「必须」放了你)。
三、案例
1)、一白人区中学,转来一名亚裔韩国学生,白人学生就挑衅并于韩国医学生约架(约驾是不违法的)。结果韩国学生打伤了白人学生。被投诉,警察抓走了他。于是韩国社区代表去警察沟通理论.了解核实情况后,被撤销投诉。
2)、一群年轻人party影响居民遭投诉。随后一黑人警察去了解情况,遭到辱骂:"黑人警察去死"。黑人警察登记车牌号时,将车上衣服碰落,对方要求捡起,警察拒绝。几天后,该青年与这名警察相遇,又发生口角。辱骂警察,警察已影响治安将其带回警局。该年轻人投诉该警察之前碰落、弄脏他的衣服需要赔偿。警局核实情况时了解到年轻人辱骂:"黑人警察去死".是种族歧视的言论。但是警察在报告中并没有相关记录并上报。于是将该黑人警察停职调查。黑人警察聘请律师投诉警局。其理由: 对方骂的是警察身份,并不是对黑人仇视。法律上骂警察是无罪的。历经近4年,警察获胜。并得到了警局的一大笔赔偿金(注:骂警察、警局可以骂肤色、国籍涉嫌种族歧视)。
